Terms

  1. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only.

  2. ELIGIBILITY

  3. Entry is only open to:

    1. Australian resident homeowners aged 18 years or older, who purchase one (1) complete Fielders Endurance structure OR one (1) complete Fielders Centenary structure (each an Eligible Purchase) for their residential property between 05/08/2019 and 24/11/2019 (Purchase Period), in a single transaction (excluding negotiated payment terms) from an Australian business supplying genuine Fielders Centenary® or Fielders Endurance® products (Homeowner); OR

    2. Fielders business account customers with a valid ABN, who supply and/or install genuine Fielders Centenary® or Fielders Endurance® products in Australia, who receive an email from the Promoter that is addressed to them, and inviting them to participate in the promotion (Eligible Business),

      (each an Entrant).

  4. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  5. No trade prize will be awarded to an owner, manager or employee of an otherwise Eligible Business that is owned by the Promoter.

  6. PROMOTIONAL PERIOD

  7. The promotion commences at 12:00am (AEST) on 02/09/2019 and ends at 11:59pm (AEDT) on 24/11/2019 (Promotional Period).

  8. HOW TO ENTER

  9. To enter the promotion, Entrants must, during the Promotional Period:

    1. access https://www.fielders.com.au/endurance-centenary2019 (Promotional Website);

    2. fully and correctly complete and successfully submit the online entry form in the manner required, including providing the Homeowner’s full name, telephone number, email, residential address, and the details of the Eligible Purchase including the value, the date the Eligible Purchase was made, the name of the business from which the Eligible Purchase was made, the ABN and location of the Eligible Business; and

    3. retain the Eligible Purchase receipt (Purchase Receipt),

      (together, an Entry).

  10. An authorised representative of an Eligible Business (Authorised Representative) may enter a Homeowner into the promotion on their behalf, with the Homeowner’s consent. Authorised Representatives must provide all required details and enter the Homeowner and their Eligible Business during the Promotional Period.

  11. Homeowner Entrants will receive one (1) Entry into the promotion per Eligible Purchase made during the Purchase Period. Multiple Entries are permitted, however each Entry must be based on a separate Eligible Purchase, must be submitted separately and must independently comply with these Conditions of Entry.

  12. Eligible Business Entrants will receive one (1) Entry into the promotion for each Eligible Purchase sold. Multiple Entries are permitted from Eligible Businesses (including from multiple individuals within multiple branches of an Eligible Business), however each Entry must be based on a separate sale of an Eligible Purchase to a Homeowner.

  13. Selection of Eligible Products is subject to availability. Eligible Products may not be available for sale from all Eligible Businesses at all times during the Promotional Period. The Promoter accepts no responsibility for Eligible Products being unavailable at a Fielders branch or from an Eligible Business during the Promotional Period.

  14. Each Homeowner must retain and may be required to present proof of purchase of each Eligible Purchase in order to claim a prize. A Homeowner may be required to provide proof of purchase for all Entries made, upon request by the Promoter. If a Homeowner is unable to provide proof of purchase for all Entries made within the required timeframes, then any Entries of that Entrant will be ineligible and deemed invalid. Proof of purchase includes showing the original and providing a copy of the Purchase Receipt for each Eligible Purchase made during the Purchase Period. Purchase Receipts must clearly specify where the Eligible Purchase was made and that the Eligible Purchase was made during the Purchase Period but prior to entry.

  15. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that Entrant invalid.

  16. Costs associated with accessing the Promotional Website remain an Entrant’s responsibility and may vary depending on the Internet service or telecommunications provider used.

  17. DRAWS

    Monthly Promotional Stages

  18. For the purpose of determining prize winners and awarding prizes, the Promotional Period will be divided into promotional stages, commencing and closing on the dates and times (AEST or AEDT depending on the date) set out below (each a Monthly Promotional Stage). Entries will be sorted by the following four (4) regions: NSW/ACT/QLD/NT, VIC/TAS, SA and WA (each, a State Group). Each State Group will have its own Monthly Promotional Stage draw at BlueScope Steel, Tower B, Level 4, 201 Coward Street, Mascot, NSW, 2020 on the date and time set out below (each a Draw).

  19. All Entries received from Entrants during the Promotional Period will be entered into a corresponding Monthly Promotional Stage Draw to determine one (1) Homeowner Prize winner and one (1) corresponding Eligible Business Prize winner in each State Group. Entries received in a given Monthly Promotional Stage will NOT rollover into any subsequent State Group Monthly Promotional Stage Draw(s) but will remain eligible for entry into the Major Prize Draw. Winners will be notified in writing within two (2) days of the relevant Draw(s). The name(s) and location(s) of the Monthly Promotional Stage winners will be published in The Australian and on the Promotional Website, in accordance with the table below, and will remain on the Promotional Website for no less than twenty-eight (28) days. All reasonable steps to notify winners of the results of the Draw(s) will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

  21. Entrants in the NSW/ACT/QLD/NT, VIC/TAS and WA State Groups are only eligible to win one (1) Monthly Prize throughout the Promotional Period per Homeowner or Eligible Business. Entrants in the South Australian State Group are eligible to win multiple prizes per month based on the number of entries submitted.

  22. Major Prize Draw

  23. The draw to determine the winners of the Major Prize Draw will take place at 2:00pm (AEDT) on 27/11/2019 at Suite 12, Level 1, 285A Crown Street, Surry Hills NSW 2010. In order to comply with national gaming regulations and legislation, an independent scrutineer will oversee the conduct of the Major Prize Draw and winner announcement as the total value of the prizes in the draw exceeds $10,000. Winners will be notified by telephone and in writing on 29/11/2019 within two (2) days of the draw. The name(s) and location(s) of the Monthly Promotional Stage winners will be published in The Australian and on the Promotional Website on 09/12/2019 and will remain on the Promotional Website for no less than twenty-eight (28) days. All reasonable steps to notify winners of the results of the Major Prize Draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

  24. Entrants in the Major Prize Draw are only eligible to win one (1) Major Prize per Homeowner or Eligible Business. Entrants from South Australia are eligible to win multiple prizes based on the number of entries submitted.

  25. Reserves

  26. The Promoter may draw five (5) additional reserve Entries in each Draw and record them (in order) in case an invalid entry or ineligible Entrant is drawn or the Entrant is ineligible to accept or declines to participate in the prize. Each Entrant whose Entry is drawn by the Promoter must confirm their eligibility to be awarded the prize and their ability to accept the prize within 14 days of being successfully notified by the Promoter that their Entry has been drawn, otherwise their Entry will be deemed invalid. In the event of an invalid entry or an ineligible Entrant, or if the Entrant is ineligible to accept or declines to participate in the prize, the prize will be awarded to the first reserve Entrant drawn. If the prize cannot be awarded to the first reserve Entrant, the Promoter will continue this process until the prize is awarded. If after this process a prize has still not been awarded, or if an Entrant drawn cannot be notified, the Promoter will hold an Unclaimed Prize Draw in accordance with Condition 32.

  27. PRIZES

  28. For each Homeowner drawn, the Eligible Business from which the Homeowner made their Eligible Purchase, will win a corresponding prize e.g. a Monthly Prize or Major Prize, subject to the Homeowner remaining eligible and any internal policy of the Eligible Business. In the event of a disagreement as to whom a prize should be awarded, the Promoter’s decision will be final and no correspondence will be entered into.

  29. No prize will be awarded to an Eligible Business or to an owner, manager or employee of an Eligible Business who is also a director, a part of management, an employee, an officer or contractor of the Promoter, or is directly involved in the management of the promotion or an agency associated with this promotion (or an immediate family member of such person). If the business listed on a winning Entry is a Fielders branch, the winning Homeowner will receive the Homeowner prize, but the employee/owner/manager from whom the Eligible Purchase was made WILL NOT be eligible to accept the corresponding prize. The Promoter will include the unawarded trade prize in the Second Chance Draw in accordance with Condition 31 in order to distribute any prize(s).

  30. Monthly Prizes: In each Monthly Promotional Stage the first (1) eligible Entry randomly drawn from all Entries received in each State Group will be awarded a Monthly Promotional Stage prize as follows:

    1. Monthly Prize – Month 1

      1. Homeowner: (1) x Vintec 35 Bottle Wine Cellar (V30SGMEBK) valued at up to $699RRP. Alternatively, the Homeowner may elect to receive a pre-paid VISA gift card to the value of $500.
      2. Eligible Business: (1) x Microsoft Surface Go 128GB Tablet (MCZ-00007) valued at up to $837RRP. Alternatively, the Eligible Business may elect to receive a pre-paid VISA gift card to the value of $500.
    2. Monthly Prize – Month 2:

      1. Homeowner: (1) x Heston Force 2 Burner BBQ, Graphite (HBG2G) valued at up to $799RRP. Alternatively, the Homeowner may elect to receive a pre-paid VISA gift card to the value of $500.
      2. Eligible Business: (1) x DJI Spark Drone Fly More Combo (Alpine White) (3661758) valued at up to $859RRP. Alternatively, the Eligible Business may elect to receive a pre-paid VISA gift card to the value of $500.
    3. Monthly Prize – Month 3:

      1. Homeowner: (1) x Strand 3 piece Lounge (STRA3PLOUL) valued at up to $899RRP. Alternatively, the Homeowner may elect to receive a pre-paid VISA gift card to the value of $500.
      2. Eligible Business: (1) x Dometic Waeco CF40 Pack Including Cover (9331391007561) valued at up to $799RRP. Alternatively, the Eligible Business may elect to receive a pre-paid VISA gift card to the value of $500.
  31. VISA gift cards are subject to their prevailing terms and conditions of use, including expiry dates, and are not replaceable if lost, stolen or damaged.

  32. If, at the end of the Monthly Promotional Stage Draw(s), there are any Monthly Prizes that have not been awarded, accepted or claimed, the Promoter will hold an Unclaimed Prize Draw in accordance with Condition 32. There are a total of 24 Monthly Prizes to be awarded in the promotion with one (1) Homeowner prize and one (1) corresponding Eligible Business prize awarded in each of the four (4) State Group across three (3) Monthly Draws (a total of 12 prizes for Homeowners and 12 prizes for Eligible Businesses). The cumulative Monthly prize pool for each State Group is $4,892.

  33. Major Prize: The first three (3) eligible Entries randomly drawn from all Entries received during the Promotional Period will each be awarded a Major Prize. Each winning Homeowner will receive a monetary prize matching the value of their Eligible Purchase. Winning Homeowners must provide an itemised invoice for their Eligible Purchase, as proof of payment, after which the funds will be reimbursed by bank transfer to the winner’s nominated Australian bank account. The amount reimbursed will be in accordance with the value of the Purchase Receipt(s) provided, with up to a maximum value of $10,000, reimbursed for the supply and installation of either one (1) Fielders Endurance structure; or one (1) Fielders Centenary structure. The Eligible Business listed on the winning Entry will receive $5,000 by bank transfer to the Eligible Business owner’s bank account. The cumulative value of the Major Prize Draw is up to $45,000.

  34. The total maximum prize pool value for each State Group is as follows: NSW/ACT/QLD/NT up to $49,892, VIC/TAS up to $49,892, SA up to $49,892 and WA up to $49,892.

  35. The prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). The prizes must be taken as offered and cannot be varied. The prizes cannot be used or redeemed in conjunction with any other offer. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.

  36. It is a condition of accepting and participating in a prize that a winner may be required to sign eligibility form(s), code(s) of conduct and/or legal release(s) (including prize acceptance release(s)) in a form determined by the Promoter in its absolute discretion.

  37. The Promoter reserves the right to request a winner produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the identity and age of the winner before issuing the prize.

  38. GENERAL

  39. Second chance draw: Any prize(s) not awarded to Eligible Businesses at the conclusion of the Major Prize Draw will be entered into a Second Chance Draw, which will take place at the same location as the Major Prize Draw, as is necessary, at 5:00pm on 27/11/2019 (Second Chance Draw). In the event of any winner(s) in the Second Chance Draw, the winner(s) will be notified by telephone and in writing on 29/11/2019 within two (2) days of the Second Chance Draw, and each winner’s name and location will be published in The Australian and on the Promoters Website on 09/12/2019 and will remain on the Promotional Website for no less than twenty-eight (28) days. All reasonable steps to notify any winner of the results of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into. Winners of Eligible Business prize(s) in State Group Monthly Promotional Prize Draw(s) and the Major Prize Draw will not be included in the Second Chance Draw.

  40. Unclaimed prize draw: The Promoter may conduct a further draw at the same time and place as the Major Prize Draw, as is necessary, on 28/02/2020 in order to distribute any prize unclaimed by that date, subject to any written directions given under applicable State or Territory legislation (Unclaimed Prize Draw). All valid Entries received during the Promotional Period (excluding those Homeowners who have already been awarded a prize) will be entered into the Unclaimed Prize Draw. In the event of any winner(s) in the Unclaimed Prize Draw, the winner(s) will be notified by telephone and in writing by 03/03/2020 within two (2) days of the Unclaimed Prize Draw, and the winner(s) name and location will be published in The Australian and on the Promoters Website on 13/03/2020 and will remain on the Promotional Website for no less than twenty-eight (28) days. All reasonable steps to notify any winner of the results of the draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

  41. The Promoter reserves the right to request that winning Entrants produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s or their employer’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the promotion, before issuing a prize. If any documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or Entry has not been verified or validated to the Promoter’s (or its nominated agent’s) satisfaction, then all the entries of that Entrant may be ineligible and deemed invalid.

  42. A prize will only be awarded following any winner validation and verification that the Promoter, or its nominated agents, requires in their sole absolute discretion.

  43. The Promoter reserves the right to verify the validity of any and all Entries and to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an Entry which is not in accordance with these Conditions of Entry; or (c) engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

  44. As a condition of entering this promotion, each Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media worldwide for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any additional documents reasonably required by the Promoter to give effect to this condition.

  45. An Entrant also agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner’s name and locality in any media, as required under the relevant State or Territory lottery legislation.

  46. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.

  47. If the promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures, directions of regulators or industry self-regulatory bodies or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide alternative prize(s) to the same value as the original prize(s), subject to any written directions made under applicable State or Territory legislation.

  48. Any attempt to cause malicious damage or interference with the normal functioning of the Promotional Website, or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.

  49. The Promoter and its associated agencies and companies exclude all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable consumer guarantee under the Australian Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prize(s); and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regard to all prize warranty claims (where applicable).

  50. An Entry and any copyright subsisting in an Entry irrevocably becomes, at time of entry, the property of the Promoter.

  51. All of the Promoter’s decisions in respect of the promotion are final and no correspondence will be entered into.

  52. PRIVACY

  53. The Promoter collects Personal Information about an Entrant to include the Entrant in the promotion, award the prizes (where appropriate) and uses the information to assist in improving the goods and services of the Promoter. If the Personal Information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible.

  54. The Promoter will provide to the Entrant, at time of entry into the promotion or as soon as reasonably practicable thereafter, a collection statement that details the Personal Information being collected, the purpose of its collection, where the Personal Information will be stored and how it will be shared with third parties. The collection statement will comply with the Promoter’s disclosure obligations under the Privacy Act 1988 (Cth).

  55. Entrants can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at privacyquestions@bluescope.com. All Personal Information will be stored by the Promoter in accordance with the Promoter’s Privacy Policy. A copy of the Promoter’s Privacy Policy in relation to the treatment of Personal Information collected may be obtained at https://fielders.com.au/privacy/.

  56. By entering the promotion, Entrants acknowledge that a further primary purpose for collection of the Entrant’s Personal Information by the Promoter is to contact the Entrant in the future with information about the Promoter, including special offers, market research or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share an Entrant’s Personal Information with its Australian and overseas related companies, servants, employees, agents and trusted third parties who may contact the Entrant for their legitimate commercial purposes, including special offers, market research or to provide the Entrant with marketing materials in this way. By entering the promotion, Entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.

  57. In these Conditions of Entry: “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth). “Personal Information” means, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
